Arizona – Violating the constitution like it’s their job. Photo-radar, racial profiling, what is next?

Immigration is going to be the heaviest debate in the wake of health-care reform.  And of course, just after the murder of a Southern Arizona rancher.  Governor Jan Brewer signed the State senate Immigration bill 1070 into law.   Admittedly by both contenders and supporters, this law is highly controversial and the toughest action towards immigration taken by the state. The bill would make it a crime for immigrants to not possess valid immigration paperwork.

I think it’s ironic that shortly after the State of AZ threatens to sue the Federal Government; claiming health care reform is unconstitutional.  The Obama administration has been given the opportunity to do the same to the Arizona State senate. Immigration bill SB1070 gives Public law enforcement agencies the means to legally demand to see valid paperwork under threat of arrest.

Wholly shit!  Really?

This is the perfect environment to foster racial profiling.  Not to mention this historically familiar stink:

…allowing the local police to enforce federal immigration laws, is a step in the right direction—if you want to emulate the Third Reich or if you want to return to the days of second class citizenship in the United States. The first thing a fascist government will do is demand that you justify your very existence, as in “Let me see your papers.” Does this person look Jewish (whatever that means)? Stop him/her!  Now substitute, does this person look Latino (whatever that means)? Stop him/her! -Maria Padilla

To be fair, the federal government has kept the issue at arms length.  And this type of action from the state might be a sort the childish ‘calling out for attention’ that gets a response.  Problem is, there are at least a million and a half legal citizens of mexican descent living here too.  And you can’t just mess with their lives like this.  Restrict access and their movement?  Unconstitutional. Period.

As for the Arizona/Mexico border itself.  The border has been publicized with the image of a war-zone.  Full of violent mexicans flooding into america.  Thieving and murdering as they go.  This is just not the case.  Crime statistics for areas in the US are cataloged. You can look them up. And border towns like Douglas Arizona have crime rates far below the national average.  http://www.cityrating.com/citycrime.asp?city=Douglas&state=AZ

Meanwhile little old Camden NJ, is rocking out on both violent and property crime. http://www.cityrating.com/citycrime.asp?city=Camden&state=NJ

The border is not a war-zone of crime.  The majority of undocumented immigrants coming across the border are not trying to hurt anyone.  They are poor people crossing the desert.

The system we have here is not set up to support poor people coming across into the US and everyones answer is that we need to stop them from coming across.  This firstly, is just not working.   The stated objective in border policy and immigration isn’t being accomplished, yet continues to be enforced. The publicity surrounding the issue claims that this is happening in waves. The press rarely asks if in fact the stated objectives (freedom, safety, law&order) are in fact different from the actual overriding objectives.  Though the numbers seem to dissagree. I think this all implies that they are succeeding at an unstated objective.  The actual accomplished objective is to generate fear, hatred and to segregate americans from each other and non-americans.

Secondly, the answer isn’t stricter immigration Laws. Or cracking down on immigration by the Federal Government OR the State of Arizona.  That disgusts me. Our similarities as humans heavily outweigh or differences across all borders and cultures. And maybe more people need to consider that it’s the system that is flawed. Not the Hispanic people.

*EDIT* 4/28/10

If the problem is illegal immigration. And trying to solve the problem by keeping immigrants out is not working. We need to change the system to one where we benefit from having immigrants here. Documented or otherwise. (this is how America got its start, and it was extremely prosperous for everyone). I learned a long time ago that you shouldn’t try the same thing over and over again and expect different results. Change is difficult, and I know no one ever wants to change themselves. It’s always easier outward, me vs them, and they must be the ones to change. But in the end, that really only makes the problem worse.  And now In the case of Arizona. We are on the verge of a huge race issue with a million people stuck in the middle. Real people, with lives and families and all that hippy la la stuff. We’re all the same. Try and treat each other as such.

  • Is it wrong to say that we're never going to solve this problem? Let's face it, the people that know what they're talking about and have valid solutions to these types of issues are never the people making the laws. Let the public vote on it, and - maybe - we might find a reasonable compromise.

The system is broken, but kicking everybody out of the country who sneaked through the broken system isn't the solution.

I'm curious about this: "I learned a long time ago that you shouldn’t try the same thing over and over again and expect different results."

    How did you learn this?

There is a legal way into this country. Coming into this country illegally is wrong. My taxes pay to support all the infrastructure, and services they use. If they came in legally, then they help pay taxes to support said infrastructure.

And what about the illegals who are driving with no license or insurance. Im sure they know all the rules when they snuck into this country and when they cause an accident It wont be me paying to fix my car. Wait, yes it will.

Come into this country legally, or don't come at all. Illegal aliens are a burden on America. The ones who choose to follow the proper path to enter this country are the ones that have similar values as the people who founded this country.

And if we have to racial profile someone to determine if they should be here, then so be it. Im sure a Hispanic in a business suit driving a decent car wont be bothered too much about this. He was either born here, or worked hard to get here properly. He might even be proud to show his "papers."

Think I can go to another country without a passport? Think they are going to not ask me to show my papers because I am white and that would be racial profiling? NOT.

America is in dire straights right now. Hispanics are not the only issue we have. But it is one that needs to be addressed. We can no longer support millions of illegal aliens here on a free ticket, using the welfare system, crowding our schools, free health care, food stamps, and not to mention their lack of responsibility for anything, and their penchant for crime including DUI, DWI, No insurance, robbery, rape, and even murder.

Learn english, follow the proper channels, and come over here legally. Help support the systems you so dearly want to use.

The people using resources like welfare are not the people like yourself who pay the taxes that fund welfare. Poor people are poor no matter if they are American citizens or undocumented "illegals." Some poor Americans aren't required to pay taxes and actually still receive money from the system.

Taxes for things like highways and roads come from gasoline sales. Gas stations don't give gas away for free to Undocumented immigrants. We are all in the same boat there.

And Schools? Immigrants you know who drink a lot and get DUI's are actually paying more into the school systems in their area. As that is where schools and police enforcement, hostpital's get a lot of their funds as well.

It's never a free ticket. They come here, are treated as second class citizens just with the hope to get a job that you don't even want to do.

And gross generalizations like "lack of responsibility for anything, robbing, raping and murdering as they go." Hey guess what? I'm sure you don't care, but your racism is showing.

    Great article!
This is more than a racial issue. Rings truer to a police state. If the governing bodies say that they will not be doing racial profiling it is still unconstitutional due to "anyone" being questioned and needing to prove that they are an American Citizen or a documented alien. I live in a free country, at least it started out that way. Police under this new law are required to ask questions of anyone who exhibits tendencies of an illegal immigrant. Yet we do not know what that means. Sounds to me like everyone will be required to have citizenship documents.
I tried to get employees, for a company I worked for in the past, legally documented so they could work here in the US. The amount of permissions are low for workers who are not in the professional category compared to the amount of jobs available. The list was 2 years before any more jobs could be had. If we have a goal to stop undocumented aliens then why aren't we allowing them to be documented?

Not disagreeing or agreeing with you...I don't know my stance on this issue yet, but here is something I found...

"Crime measurement is particularly troublesome for illegal immigrants. Immigrants may be apprehended by federal, state, or local authorities for criminal acts, but many illegal immigrants are apprehended by the Border Patrol and other enforcement officers of the Immigration and Naturalization Service (INS). Many illegal immigrants who are apprehended by Border Patrol agents are voluntarily returned to their home countries and are not ordinarily tabulated in national crime statistics. If immigrants, whether illegal or legal, are apprehended entering the United States while committing a crime, they are usually charged under federal statutes and, if convicted, are sent to federal prisons. Throughout this entire process, immigrants may have a chance of deportation, or of sentencing that is different from that for a native-born person"

  • Is that saying that crime statistics do not include crimes attributed to undocumented immigrants?

That sounds to me like cases involving the detection of undocument immigrants in an act. But even without detection, unsolved crimes are still reported as local crimes.

And what of the literal crime of just being here? It's not a violent act. And wouldn't be counted either.

I was trying to objectify an idea. I have family on a border town. I've been there. Actually, you have too. So you know, Immigrant crime just isn't as big of a problem as the media claims. And calling upon the fed for national guard backup, and having checkpoints. over-publicizing a single crime does more harm to the community, than good. Especially to businesses in the social climate of the community.

Something else that is interesting to me...try looking up people in the USA being arrested for not being able to show ID.

    http://www.michaelrighi.com/20...

That is an interesting story in my opinion...

Mexicans aren't the only people that cross the border.
  • Valid comment. It might be better suited to use the word 'Hispanic.'
